Terms & Conditions

These Terms and Conditions (“Terms”) are a legal agreement between you (“Client”, “you”, “your”) and So! Food Photography (“Photographer”, “we”, “us”, “our”), governing the supply and use of our food photography services.

By engaging our services, paying a deposit, accepting a quote, or otherwise indicating acceptance, you agree to be bound by these Terms.

1. Definitions

1.1 Agreement means these Terms, the Quote, and any attachments or schedules between you and the Photographer.

1.2 Services means the provision of professional food photography, including pre-shoot preparation, the photo session itself, and post-production editing as agreed in the Quote.

1.3 Deliverables means the final edited images or other media delivered to you.

1.4 Quote means the written proposal or estimate provided by the Photographer detailing the Services, fees, and any specific terms related to a shoot.

2. Application

2.1 These Terms apply to all Services provided by the Photographer, whether supplied to a business or individual.

2.2 The Agreement forms the entire contract between you and the Photographer and supersedes all prior discussions, emails, proposals, or understandings.

2.3 Any variation or agreed amendment to the Agreement must be in writing and signed by both parties.

3. Booking, Fees, and Payment

3.1 A booking is only confirmed once:

You accept the Quote in writing or by email; and a non-refundable deposit (as stated in the Quote) is paid.

3.2 The balance must be paid in full no later than the date specified in the Quote or prior to delivery of the Deliverables, whichever comes first.

3.3 If payment is late, the Photographer may withhold Deliverables and charge interest on overdue amounts at 4% per annum above the Bank of England base rate until payment is made.

4. Scope of Services

4.1 The Photographer will provide the Services as specified in the Quote, including agreed locations, dates, times, and deliverables.

4.2 The Client must provide all relevant information, access, and assistance necessary for the Photographer to perform the Services.

5. Cancellation, Rescheduling, and Refunds

5.1 Cancellation by Client:
If you cancel the booking after payment of the deposit, the deposit is
non-refundable.

5.2 Rescheduling:
Requests to reschedule must be made in writing. The Photographer will use reasonable efforts to accommodate changes but is not obligated to do so.

5.3 Cancellation by Photographer:
If the Photographer must cancel (e.g. due to illness or emergency), every effort will be made to offer a replacement or refund any deposit received.

5.4 In all cases, the Photographer’s liability is limited to a refund of fees already paid under this Agreement.

6. Delivery and Turnaround

6.1 Deliverables will be provided by the date stated in the Quote or within a reasonable time if no date is specified.

6.2 Turnaround times may be affected by seasonal demand, third-party labs, or unforeseen circumstances. The Photographer will provide updates where reasonable.

7. Copyright, Licence, and Usage Rights

7.1 Copyright in all Deliverables belongs to the Photographer as created, under the Copyright, Designs and Patents Act 1988 unless otherwise agreed in writing.

7.2 The Photographer grants the Client a non-exclusive licence to use the Deliverables for the uses outlined in the Quote (e.g., menu, website, social media).

7.3 Any use outside the agreed licence (including resale, third-party licensing, or commercial exploitation) requires additional licensing and fees.

8. Model and Property Releases

8.1 You are responsible for obtaining any necessary permissions, including model releases for identifiable individuals and property releases for private locations.

8.2 The Photographer may request the Client supply these in advance.

9. Liability and Indemnity

9.1 The Photographer will perform Services with reasonable skill and care.

9.2 Except as required by law, the Photographer’s liability for any loss arising under this Agreement is limited to the total fees paid by you.

9.3 The Photographer is not liable for indirect or consequential loss, loss of profits, or business interruption.

9.4 You agree to indemnify the Photographer against claims by third parties arising from your use of the images beyond agreed uses.

10. Equipment, Safety, and Conduct

10.1 The Photographer uses professional equipment and will take reasonable care. You must ensure a safe environment for the shoot.

10.2 The Client is responsible for any damage or loss caused to the Photographer’s equipment by anyone other than the Photographer.

10.3 The Photographer may refuse to perform Services if safety concerns arise.

11. Data Protection and Privacy

11.1 The Photographer will collect and process personal data to deliver the Services (e.g. name, contact details, images).

11.2 Personal data will be handled in accordance with UK GDPR and the Photographer’s Privacy Policy (separate document).

11.3 Images may contain personal data (identifiable individuals) and you are responsible for ensuring you have consent to hold and use such images.

12. Force Majeure

12.1 The Photographer is not liable for failure to perform due to causes beyond reasonable control (e.g. extreme weather, illness, acts of God).

12.2 In such cases, the Photographer may reschedule or refund fees paid.

13. Governing Law

13.1 This Agreement is governed by the laws of England and Wales.

13.2 Any dispute arising under this Agreement shall be subject to the non-exclusive jurisdiction of courts in England and Wales.

14. Acceptance

By paying a deposit, accepting a quote, making a booking, or accepting delivery of images, you acknowledge that you have read and agreed to these Terms and Conditions.me what you need next.
